PRACTICE AREAS

Governmental/Civil Rights Law
We have a unique expertise dedicated to representing public entities such as cities, counties, and school districts in a multitude of areas. Such claims include police brutality, wrongful arrest, police misconduct, First Amendment claims, zoning, and defective road conditions. As litigation counsel for one of Georgia's largest school districts, we have experience in claims unique to schools such as Title IX and special education issues. We are also consulted to assist public entities in avoiding litigation by taking affirmative steps such as redrafting local ordinances and personnel policies.

Employment Law
We represent both public and private employers in a wide array of claims, including Title VII violations (e.g., race/gender/age discrimination), sexual harassment, ADA (disability) discrimination and wrongful discharge. We counsel public and private employees in the many aspects of the employment process while also ushering them through any inquiries or investigations initiated by the EEOC.

Automotive and Trucking Litigation
A large portion of our defense practice is devoted to representing members of the trucking industry, including shippers, motor common carriers and their insurers, in direct actions. For claims arising from non-truck motor vehicle collisions, we represent individual insureds and insurers on uninsured and underinsured motorist claims.

Premises Liability
We defend a variety of claims arising from the operation, maintenance and use of commercial and private premises. Our clients include restaurant and retail owners in slip and fall and food contamination cases. We represent apartment complexes and property management companies against claims arising from third-party criminal acts including rape, sexual assault, and other personal injury claims.

Medical and Healthcare Professional Liability
We represent medical professionals and medical providers such as physicians, nurses, nursing homes and other corporations providing medical treatment in medical malpractice actions.

Professional Liability
We represent real estate agents, real estate brokers, buyers and sellers in claims arising from residential and commercial property transactions. We also have experience in representing builders, contractors, accountants, officers and directors, physicians, attorneys and educators in malpractice and fraud actions.

Insurance Coverage Disputes and Bad Faith Claims
We regularly provide coverage opinions, bilateral and unilateral reservation of rights letters, and file complaints for declaratory judgment to adjudicate coverage disputes. We also handle coverage disputes extending into bad faith claims in the context of either a failure to defend or indemnify.

Products Liability
We represent large companies in civil matters involving product defects, design defects, manufacturing defects, and breach of warranty. Many of these matters arise out of catastrophic injuries or death allegedly caused by the product. Our experience includes lawsuits involving motor vehicles, heavy equipment and complex manufacturing equipment.

Construction Law
The firm represents general contractors, subcontractors, and product manufacturers in all aspects of construction litigation.  This practice area covers a wide breadth of construction litigation issues including contractual disputes, coverage questions, product defects, architect and engineer liability, and design and construction negligence.  Because the firm has extensive insurance coverage experience, it brings unique experience to the table in handling very complicated construction insurance coverage claims.

Commercial Litigation
We represent companies and enterprises in reviewing contracts and handling matters involving interpreting contracts, enforcing contracts, and defending breaches of contracts.  The firm drafts contracts for clients with the unique perspective of understanding which issues are likely to be litigated.

Contingent Fee Litigation and Subrogation Recovery
We represent insurance carriers on significant subrogation and business matters. Also, we selectively handle wrongful death claims and claims involving individuals who have suffered catastrophic or serious injury.  

Food Contamination/Adulteration
We represent national restaurant chains and product manufacturers in food contamination and adulteration matters including claims involving Salmonella and E Coli as well as bacteria in sea foods such as oysters and shell fish.   The firm has successfully tried or gotten dismissed several such claims against our clients.  Additionally, the firm has been retained to handle large scale outbreaks related to food contamination/adulteration claims.

Foreclosures
Our staff is fully trained and experienced in handling all aspects of foreclosure-related matters, from intake, title review, litigation, and sale. We handle REO's, evictions, sales and foreclosures in every locale in New York. Our relationship with various title companies and other professionals ensure that our clients' matters are handled and completed expeditiously and efficiently.

Litigation/Project Management
We have expertise and a national reputation in handling litigation matters in an aggressive, economical and efficient manner.  As a result, this expertise has been employed by clients to developing strategic planning to manage, control, contain, audit, etc. various exposures such as national insurance programs, class actions, multi-district litigation, and other complex or wide-scale continuing exposures.
